Welcome to the Figurin 'It Out website, located at www.alifigurin.com (the “Site”). The Site is owned and operated by Figurin' It Out Counseling & Consulting PLLC, doing business as Figurin' It Out Counseling & Consulting (“Figurin It Out,” “we,” “us,” or “our”). By accessing or using this Site, you agree to these Terms and Conditions.
If you do not agree with them, please do not use the Site.
1. Information Only
The content on this Site is provided for general informational and educational purposes. It is not intended to replace individualized professional advice, diagnosis, assessment, or treatment.
Reading this Site, downloading a resource, subscribing to communications, or submitting a contact form does not create a therapist-client, counselor-client, coach-client, consultant-client, or other professional relationship with Figurin' It Out or Ali Figurin.
A professional relationship is established only after the parties have completed the appropriate intake or engagement process and entered into a separate written agreement.
2. Counseling and Mental Health Information
Nothing on this Site should be interpreted as mental health treatment, medical advice, diagnosis, or a guarantee that counseling services are appropriate or available to you.
Professional counseling services are provided only where Ali Figurin is legally authorized to practice and are governed by separate disclosures, consent documents, privacy notices, and service agreements.
Figurin It Out’s website Privacy Policy is not a substitute for any Notice of Privacy Practices that may apply to protected health information created or maintained in connection with clinical counseling services.
3. Coaching, Consulting, and Speaking Services
Coaching, consulting, speaking, and educational services are not psychotherapy, medical care, or emergency services. These services do not include diagnosing or treating mental health conditions unless expressly provided within a separately established clinical counseling relationship.
Specific terms – including scope, fees, scheduling, cancellations, confidentiality, and deliverables – will be addressed in the agreement applicable to the service being provided.
4. Emergencies and Crisis Situations
This Site is not monitored continuously and should not be used for emergencies, urgent mental health needs, or crisis communication.
If you or someone else may be in immediate danger, call 911 or go to the nearest emergency room. In the United States, you may also call or text 988 to reach the Suicide & Crisis Lifeline.
Do not submit urgent, highly sensitive, or detailed health information through the Site’s general contact forms.
5. No Guarantee of Results
Every individual, team, and organization is different. Figurin It Out does not promise or guarantee any particular personal, professional, athletic, organizational, financial, health, or performance-related result.
Testimonials, examples, and descriptions of past experiences illustrate individual perspectives. They do not guarantee that another person or organization will experience the same outcome.
6. Minors
The Site is intended for a general audience and is not directed to children under 13.
A parent or legal guardian must initiate inquiries concerning services for a child under 13. Services involving minors may require parental or legal-guardian consent, subject to applicable law and the nature of the service.
7. Intellectual Property
Unless otherwise stated, all materials on the Site—including text, graphics, photographs, branding, logos, downloads, worksheets, videos, designs, and other original content—are owned by or licensed to Figurin It Out and are protected by applicable intellectual-property laws.
You may view and print Site materials for your own personal, noncommercial use. You may not reproduce, sell, modify, publish, distribute, repurpose, or commercially exploit Site materials without prior written permission.
8. User Conduct
You agree not to:
Use the Site for unlawful, fraudulent, or harmful purposes.
Attempt to gain unauthorized access to the Site or its systems.
Introduce malware or interfere with the Site’s operation.
Impersonate another person or provide deliberately false information.
Copy, scrape, or systematically collect Site content without authorization.
Engage in any and all cyber–bullying behavior.
Violate another person’s privacy or intellectual-property rights.
We may restrict access to the Site if we reasonably believe it is being misused.
9. Respectful Use and Prohibited Conduct
Figurin’ It Out Counseling & Consulting is committed to maintaining spaces – online and offline – that are accessible, inclusive, affirming, and grounded in human dignity.
We do not tolerate discrimination, bigotry, bullying, harassment, intimidation, hate speech, threats, exploitation, retaliation, or conduct intended to demean, frighten, silence, or exclude another person.
Prohibited conduct includes, but is not limited to:
Racism
Ableism
Antisemitism
Islamophobia
Xenophobia
Sexism
Misogyny
Homophobia
Transphobia
Religious intolerance
Ageism
Body shaming
Or other identity-based hostility
Slurs, degrading language, hate speech, or dehumanizing statements
Bullying, intimidation, humiliation, or repeated personal attacks
Threats, stalking, or encouragement of violence or self-harm
Sexual harassment, exploitation, or unwanted sexual communication
Deliberately disclosing another person’s confidential or private information
Impersonation, deception, or malicious misrepresentation
Retaliation against someone who raises a good-faith concern
Conduct that interferes with another person’s safety, access, participation, or ability to use the Site
Disagreement is not prohibited, and people may ask difficult questions, express different perspectives, make mistakes, and continue learning. However, disagreement does not justify threats, harassment, cruelty, dehumanization, or attacks on another person’s identity or humanity.
We reserve the right, when reasonably appropriate and permitted by law, to remove submitted content, restrict access to the Site, discontinue communication, deny participation in a public or group offering, cancel an engagement, or take other appropriate action in response to threatening, discriminatory, abusive, harassing, fraudulent, or persistently disruptive conduct.
These provisions are not intended to prevent anyone from:
Making a good-faith report of misconduct
Describing an experience of harm
Requesting an accommodation
Expressing a concern or complaint
Establishing a personal boundary
Seeking emergency or professional assistance
Exercising a right protected by law
Retaliation against a person for making a good-faith accessibility, safety, discrimination, or conduct report is prohibited.
The application of this section to an existing counseling relationship will remain subject to applicable professional, ethical, clinical, and legal obligations. Nothing in these Terms should be interpreted as permitting the inappropriate termination, denial, or disruption of healthcare services.
9. Third-Party Services and Links
The Site may link to scheduling systems, social platforms, payment processors, educational resources, or other third-party websites and services. Those third parties operate independently and may have their own terms and privacy practices.
Figurin It Out is not responsible for the availability, security, accuracy, content, or practices of third-party services. A link does not necessarily constitute an endorsement.
10. Site Availability and Accuracy
We work to keep the Site useful, accurate, and available, but we cannot guarantee that every page will always be complete, current, uninterrupted, or error-free.
Information – including service descriptions, credentials, availability, pricing, and resources – may be updated at any time without notice.
11. Disclaimer of Warranties
To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied.
This provision does not limit any rights that cannot legally be waived.
12. Limitation of Liability
To the fullest extent permitted by law, Figurin' It Out and its owner, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your access to or use of – or inability to use – the Site.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Figurin It Out and its owner, contractors, and representatives from claims, losses, or expenses arising from your unlawful misuse of the Site or violation of these Terms.
14. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute relating to the Site will be brought in a court of competent jurisdiction located in Denver, Colorado, unless applicable law requires otherwise.
15. Changes to These Terms
We may update these Terms periodically. The revised version will be posted on this page with a new effective date. Your continued use of the Site following an update constitutes acceptance of the revised Terms.
